Terms & Conditions for Internet Orders only

1.a In these terms and conditions:

'Goods' means the goods (including any instalment of the goods or any parts for them) which the supplier is to supply in accordance with these terms and conditions

'Supplier' means Carpet and Bed Depot Limited
'Website' means home-love.co.uk

1.b No variation to these terms and conditions shall be binding unless agreed in writing by the supplier.

1.c An order for goods placed by the buyer through the supplier’s website shall be subject to these terms and conditions.

1.d Nothing in these terms and conditions shall affect the statutory rights of any consumer.

2.a These terms of sale apply to all goods supplied by the supplier.

2.b The contract is subject to the buyer’s right of cancellation (see below).

2.c All orders for goods shall be deemed to be an offer by the buyer to purchase goods pursuant to these terms and conditions.

2.d The buyer shall be responsible for ensuring the accuracy of the details provided on the order form and the supplier will not be obliged to accept an order unless all details requested on the order form have been entered correctly.

2.e No order submitted by the buyer shall be deemed to be accepted by the supplier unless and until the supplier confirms acceptance of the buyer order by e-mail or telephone.

3. Description of goods and Price

3.a The description and price of the goods the buyer order will be as shown on the suppliers website at the time the buyer places the order.

3.b The goods are subject to availability. If on receipt of the order, the goods the buyer has ordered are not available in stock, the supplier will inform the buyer as soon as possible and refund or re-credit the buyer within 30 days for any sum that has been paid by the buyer or debited from the buyer credit card for the goods.

3.c All goods are simple self assembly unless advertised as assembled. Delivery to accessible main door unless otherwise stated.

3.d Every effort is made to ensure that prices shown on the supplier’s website are accurate at the time the buyer places the order. If an error is found, or if prior to delivery the price of the goods increases due to any factor beyond the supplier’s control, the supplier will inform the buyer as soon as possible and offer the buyer the option of reconfirming the order at the correct price, or cancelling the order. If the supplier does not receive an order confirmation from the buyer within 14 days of informing the buyer of the error, the order will be cancelled automatically. If the buyer cancels the order, or if the order is cancelled automatically due to the expiry of the 14 day period, the supplier will refund or re-credit the buyer for any sum that has been paid by the buyer or debited from the buyer’s credit or debit card.

3.e In addition to the price, the buyer may be required to pay a delivery charge for the goods in the amount as set out on the order form.

3.f The buyer is solely responsible for ensuring the accuracy of the terms of any order (including any applicable specification) and for selecting the goods and for giving the supplier any necessary information relating to the goods within a sufficient time to enable the supplier to perform the contract in accordance with its terms.

3.g Colours and shades of furniture and fabrics are shown from photographic images and there may be variation in shades due to lighting in the buyer’s property.

4. Payment

4.a Payment for the goods and delivery charges can be made by any method shown on the suppliers website at the time the buyer places the order. Unless otherwise agreed, payment shall be due upon ordering to reserve stock and payment shall be a fundamental term of this agreement, breach of which shall entitle the supplier to terminate the contract immediately.

4.b By placing an order, if applicable the buyer consents to payment being charged to the buyer’s credit or debit card account as provided on the order form.

4.c There will be no delivery until cleared funds are received.

4.d The buyer, warrant that all details provided on the order form for the purpose of purchasing the goods are correct, that the credit or debit card the buyer may be using is the buyer’s own and that there are sufficient funds and or sufficient credit available to cover the cost of the goods.

4.e The supplier will issue the buyer with an electronic receipt to the buyer email address once the goods have been dispatched.

5. Delivery, returns and cancelations.

5.a Delivery of the products shall be made by the seller or his agent. Notifying the buyer that the products are available for collection at the supplier’s premises or for delivery to such place as the buyer may specify at the time the order is placed.

5.b The supplier shall use his reasonable efforts to meet any date agreed for delivery. In any event time of delivery shall not be of the essence.

5.c The supplier shall not be liable for any delay in delivery.

5.d Where possible all items will be delivered at the same time and on the same order.

5.e An order may be cancelled at any time between the placement of the order and 14 working days following delivery of the goods.

5.f All cancellations must be confirmed in writing by letter or e-mail.

5.g Unless orders are cancelled in writing, a £40 charge will apply for attempted delivery or refusal of goods, which will cover the courier costs.

5.h Some items are made specifically to order. Where these items have been ordered and paid for by Carpet and Bed Depot Limited, and these are subsequently cancelled by the customer for reasons other than damage then Carpet and Bed Depot Limited reserves the right to charge 50% of the value of the goods ordered.

5.i If the buyer is dissatisfied with his purchase for any reason he may, within 14 working days of delivery, inform the seller’s customer service department in writing to arrange for collection of the goods at the buyer’s expense or the buyer can return the goods at a cheaper cost using another service with adequate insurance for the safe protection of goods in transit. Any money paid in the original purchase will be refunded within 30 days less the cost of returning the goods if the seller collects, provided that the seller receives the goods in the same condition they were in at the time of delivery to the buyer in their original packaging perfect and un-opened. We cannot accept returned goods that have been assembled, or part assembled or used, no matter when the return is requested.

5.j The cost of returning goods will be levied at £95 on the sellers collection service. Items which are not adequately packaged at time of collection will not be collected. If goods are deemed faulty or damaged then we will replace damaged parts immediately upon e-mail confirmation of the damaged part and a photographic image showing the damage. Should items be returned by the customer and costs incurred without prior consent then we cannot be held responsible for covering those charges. If the buyer chooses not to accept a damaged part notified within 48 hours of receipt of goods, the product can be returned at the buyer’s expense in the normal way of our returns procedure.

5.k Upon delivery a responsible adult must be available at the address to check and acknowledge receipt in a safe and satisfactory condition.

5.l Upon receipt of the goods all items are to be checked by the buyer. Any damages, shortages or discrepancies must be notified in writing to our customer services department within 14 working days, otherwise we cannot supply free replacement parts. Even if the buyer is not assembling the product’s, the buyer is still required to check the individual parts within 14 working days after receipt of goods.

5.m For reasons of hygiene, we cannot accept returns of mattresses or sleep products once unwrapped.

6.0 Title/risk

6.a The goods are at the buyer risk from the time of delivery.

6.b Ownership of the goods shall not pass to the buyer until the supplier has received payment in full.

6.c The supplier shall be entitled to recover payment for the goods even though ownership of any of the goods has not passed from the supplier.

7.0 Warranty

7.a All goods supplied by the supplier are warranted free from defects for 12 months from the date of delivery (unless otherwise stated). This warranty does not affect the buyer’s statutory rights as a consumer.

7.b This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by the buyer or any third party, use otherwise than as recommended by the supplier, failure to follow the supplier’s instructions, misuse, or any alteration or repair carried out without the supplier’s approval.

7.c This warranty does not apply and the supplier shall be under no liability in respect of any defect in the goods arising from any drawing, design or specification supplied by the buyer or any installation of the goods by the buyer or the buyer’s contractor.

7.d If the goods supplied to the buyer are damaged on delivery or don’t correspond with specification, the buyer should notify the supplier in writing via the e-mail address shown within the contact us section of the website as soon as possible.

7.e If the goods supplied to the buyer develop a defect in relation to their quality or condition while under warranty the buyer should notify the supplier in writing via the e-mail address shown within the contact us section of the website, as soon as possible, but in any event within a reasonable time after discovery of the defect or failure.

7.f Where any valid claim in respect of any of the goods which is based on any defect in the quality or condition of the goods or their failure to meet specification, is notified to the supplier in accordance with these conditions of supply, the supplier shall be entitled to replace the goods (or the part in question) free of charge or, at the supplier's sole discretion, refund the buyer the price of the goods (or a proportionate part of the price), but the supplier shall have no further liability to the buyer.

8.0 Limitation of liability

8.a The supplier shall not be liable to the buyer, for any loss or damage in circumstances where there is no breach of a legal duty owed to the buyer by the supplier or by its employees or agents;

8.b The supplier shall not be liable to the buyer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of the supplier, its employees or agents or otherwise) which arise out of or in connection with the supply of the goods or their use by the buyer, other than as a result of a breach of an obligation arising under the Sale of Goods Act 1979 (as amended), and the entire liability of the supplier under or in connection with the contract shall not exceed the price of the goods, except as expressly provided in these conditions of supply.

8.c Nothing in these conditions excludes or limits the liability of the supplier for death or personal injury caused by the suppliers negligence or fraudulent misrepresentation.

8.d The supplier will use all reasonable endeavours to carry out its obligations within a reasonable period of time but will not be liable to the buyer, for any loss, costs or expenses arising directly or indirectly from any delays in doing so and we will not be deemed to be in breach of contract by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the goods, if the delay or failure was due to any cause beyond our reasonable control. Without prejudice to the generality of the foregoing, the following will be regarded as causes beyond the supplier’s reasonable control:

The supplier will take all reasonable precautions to keep the details of the order and payment secure but unless the supplier is negligent, the supplier will not be liable for unauthorised access to information supplied by the buyer.

10. Website

10.a Product images are for illustrative purposes only and the goods may differ slightly from the images shown on the website.

10.b The supplier will attempt to ensure that the information available on the website at any time is accurate. However, the supplier will not be held liable for any errors or omissions. The supplier will use all reasonable endeavours to correct errors and omissions as quickly as practicable after becoming aware or being notified of these.

10.c All drawings, descriptive matter and specifications of the goods on the website are for the sole purpose of giving an approximate description of the goods.

10.d The supplier may also change, suspend or discontinue any aspect of the website, including the availability of any features, information, database or content or restrict access to parts or all of the website without notice or liability.

11. General

11.a These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.

11.b If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provision in question will not be affected.
